What is Personal Data
The Cayman Kids Helpline website is designed to be totally anonymous. Alex Panton Foundation does not collect or store any information about the use of this website, or associated mobile apps. We do not use cookies or any other usage tracking technologies. However, there may be some personal data collected when accessing our phoneline or textline features.
What is Personal Data
Personal Data is anything that can identify you in some way. It can include lots of things, like your name, your address, your date of birth and even a photo of you. It also includes your health, your sexuality and your computer's IP address, and includes things you've told us about yourself like what you've done and how you're feeling. If you use the Kids Helpline phoneline or textline, we may collect the following information about you:
- basic contact details, including your name (if you choose to share it),
- telephone or mobile number
- IP address
- age and gender (if you choose to share it)
Some of your Personal Data is more important, or special, because it is very sensitive. We will only collect this special information if we have an important reason and we will look after it as carefully as possible. We may collect the following special information (if you share these details):
- health information, such as illnesses you may have or medicines that you might take
- your sexuality
- your ethnicity, religion or cultural background
Our Commitment to Privacy
Kids Helpline is committed to protecting the privacy of our clients and the Personal Data provided to us.
The Foundation is sensitive to the privacy concerns of our clients and our obligations with respect to data collected under applicable laws including, without limitation, the European Union's Regulation 2016/679, the General Data Protection Regulation (GDPR) and the Cayman Islands Data Protection Act (as amended) (DPL) (GDPR and DPL together, the Data Protection Act). We have a policy of protecting the confidentiality and security of information we collect about you. We are providing you this notice to help you better understand what kinds of information we collect about you, the purposes for which information is intended to be processed and the circumstances in which that information may be disclosed to third parties. By disclosing any Personal Data to the Foundation, you acknowledge and consent, to the maximum extent permitted by applicable law, that we may collect, use, disclose and share your Personal Data (as defined below) on the terms described in this privacy policy notice (Privacy Policy Notice).
We have a range of safeguards in place to protect information from misuse, interference, and loss, and from unauthorised access, modification, and disclosure.
Why We Collect Personal Data
Kids Helpline collects Personal Data from you so we can tailor our counselling support to your particular needs and circumstances. We use your Personal Data to help us support you in the best way we can. We will use it for things like:
- Keeping notes of our conversations in 1-2-1 chats, over the phone, messages to Kids Helpline.
- Referring to these notes when you contact us again to make sure we can give you the best help
- Looking at the quality of the conversations with you for training our staff and volunteers.
- Understanding the types of things affecting young people to help us improve our service
- Sharing your information with other people if you ask us to or we need to
How We Collect Personal Data
- When you contact and use Kids Helpline phoneline and textline, our data systems may automatically collect Personal Data about you, such as your phone number and IP address.
- The Kids Helpline counsellor you talk to may also record Personal Data about you. This includes, where appropriate, creating a case file about you that includes any case notes we make and any information you may share with us.
- We may also record your call or online session. If you do not want your call recorded or want to know more about what we do with the information you tell us, just ask your counsellor.
Providing Your Name and Information
You do not have to tell us your name when using Kids Helpline. You may choose not to give any name or you may choose to use a different name (such as a ‘nickname’).
Not giving us your real name, and/or not giving us relevant or accurate Personal Data (such as your contact details) may affect the level of service and care we can provide you and the outcomes you achieve from using our service.
Sharing Your Information
The Kids Helpline is a safe place to talk. Whenever you speak to us it’s confidential and we won’t tell other people what you’ve said. We only might need to say or do something (including share your Personal Data) if:
- you ask us to
- we believe your life or someone else's life is in danger
- you're being hurt by someone in a position of trust who is able to hurt other children like a teacher, religious leader, sports coach, police officer or doctor
- you tell us that you're seriously hurting another person
- you tell us about another child who's being hurt and is not able to tell someone or understand what is happening to them
- we're told we have to by law, for example for a court case
We will always attempt to gain your participation and consent before sharing information about you providing it is safe and practicable for us to do so, taking into account the circumstances.
Accessing and Correcting Your Information
Contacting Kids Helpline is confidential. This means we can only give out records and Personal Data if you give us information that helps us find the right notes. You can request access to your information by emailing info@alexpantonfoundation.ky and we will provide you with a copy of your Personal Data if we are able to identify you.
Your rights
You have various rights in relation to your Personal Data, including the following:
- the right to obtain information regarding the processing of your Personal Data and access to the Personal Data which the Foundation holds about you;
- the right to withdraw your consent to the Foundation's processing of your Personal Data at any time, if relevant. Please note, however, that the Foundation may still be entitled to process your Personal Data if it has another legitimate reason (other than consent) for doing so;
- in some circumstances, the right to receive some Personal Data in a structured, commonly used and machine-readable format and/or request that the Foundation transmit that data to a third party where this is technically feasible. Please note that this right only applies to Personal Data which you have provided to the Foundation;
- the right to request that the Foundation rectifies your Personal Data if it is inaccurate or incomplete
- the right to request that the Foundation erases your Personal Data in certain circumstances. Please note that there may be circumstances where you ask us to erase your Personal Data but the Foundation is legally entitled to retain it;
- the right to object to, and the right to request that the Foundation restrict, its processing of your Personal Data in certain circumstances. Again, there may be circumstances where you object to, or ask the Company to restrict, its processing of your Personal Data the Foundation is legally entitled to continue processing your Personal Data and/or to refuse that request;
- the right to ask us not to subject you to automated decision making that uses your Personal Data; and
- the right to lodge a complaint with the Ombudsman in the Cayman Islands or the local data protection regulator if you think that any of your rights have been infringed by the Foundation.
The Foundation will respond to your request in writing, or orally if requested, as soon as practicable and in any event not more than within one (1) month after of receipt of your request.
